These General Terms and Conditions govern the procedure, terms, and manner of participation in the campaign "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia", organized by "Vida Wine and Spirits" Ltd., UIC BG205935679, hereinafter referred to as "the Organizer". Participants in the campaign are obliged to comply with the terms and provisions of the Campaign Rules set out below. The General Terms and Conditions are published on www.vida.bg.

The General Terms and Conditions are published on vida.bg. The campaign is conducted in the online store www.vida.bg, owned by the Organizer.

I. Campaign description and conditions for participation.

1. The campaign "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia" is conducted from September 5, 2022, to October 4, 2022 ("Campaign Period") on the territory of the Republic of Bulgaria. During this period, anyone wishing to participate must complete the following steps:
   

1.1 Register on vida.bg or log in to the site with their already registered username and password.

1.2. Purchase products worth a MINIMUM OF BGN 150.00 WITH VAT in one order from the campaign products "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia" in the online store vida.bg during the period from September 5, 2022, to October 4, 2022.

Each new, separate order from a participant with one profile and registration, containing products from "Whiskey Pass" with a minimum value of BGN 150.00 with VAT is considered a new entry in the campaign: "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia", and each participant can participate more than once during the campaign period. Upon fulfilling the conditions specified in Section I, the user automatically participates in the campaign.

2. Only legally capable natural persons, aged 18 (eighteen) years or older, residing in the Republic of Bulgaria, who have given their explicit written consent to participate, may participate in the campaign "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia", with the exception of employees of the Organizer, members of their families (including ascendants and descendants up to the second degree, spouses, and collateral relatives up to the second degree), as well as persons who participated in the organization and conduct of the campaign. ("Participants").

3. All participants aged 18 and over who have participated in the game "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia" will participate in a draw, which will randomly select a total of 20 winners who will receive one of the prizes described in point 4 Prize Fund, depending on the order of their drawing.

The winners, determined in stages by draw, will be announced on the following dates:

• September 12 – 5 people receive x 1 Whiskey Fest Sofia pass, granting three-day entry to the event. This year the festival takes place from October 7 to 10 at Paradise Center.
• September 19 – 5 people receive x 1 Whiskey Fest Sofia pass, granting three-day entry to the event. This year the festival takes place from October 7 to 10 at Paradise Center.
• September 26 – 5 people receive x 1 Whiskey Fest Sofia pass, granting three-day entry to the event. This year the festival takes place from October 7 to 10 at Paradise Center.
• October 4 – 5 people receive x 1 Whiskey Fest Sofia pass, granting three-day entry to the event. This year the festival takes place from October 7 to 10 at Paradise Center.

The winners will be announced on the Organizer's Facebook page @VidaWineAndSpirits as a comment under the post announcing the start of the game, including their first name and the initial of their last name.

The winners will also be announced on the website "Whiskey Pass" - see how you can win one of 20 passes for Whiskey Fest Sofia" with their first name and the initial of their last name.

4. The prize fund of the campaign consists of 20 passes for Whiskey Fest Sofia. Each pass grants three-day entry to the event. This year the festival takes place from October 7 to 10 at Paradise Center.

The Organizer reserves the right, at its discretion or in case of force majeure, to replace the won prize with one of a similar type and/or equivalent value.

Winners are not entitled to request the monetary equivalent of the won prize or its exchange for other goods or services.

The prize is personal and is given to the winner; it cannot be sold, given, or transferred to one or more third parties.

5. When publishing the winners, names will be pseudonymized, with only the first name and the initial of the last name from the participants' username on the website being published. The names of the winning participants will be announced on:

The organizer will contact the winners so that they can receive their prizes in person in Sofia, VIDA Boutique - 113 Bulgaria Blvd, from 10:00 to 22:00.

Prizes will be provided free of charge to the winning participants who come to collect them in person at the specified address in Sofia, VIDA Boutique, 113 Bulgaria Blvd, from 10:00 to 22:00, and provide their full names and order number with which they won for confirmation and verification of the winning person's identity.

The prize may be collected by the person who won the prize upon presentation of an identity card for its receipt - we require confirmation that the person is 18 years of age or older. It is permissible for the prize to be collected by a person other than the winning participant if the recipient certifies in writing that they have received the prize on behalf of the winner.

The use of any methods that in one way or another "automatically" add registrations instead of participants is prohibited. Any participant who attempts to violate or violates the General Terms and Conditions will be automatically disqualified by the Organizer.

The following actions are explicitly considered a violation: a) the use of techniques and/or technologies that alter the element of personal and individual participation of the respective natural person in the campaign; b) any other action that changes the mechanism for participation in the campaign or increases the chances of winning for any participant beyond the mechanism described in these Rules. The decision for disqualification is solely at the discretion of the Organizer, and the Organizer is not obligated to explain the methods for determining an attempt or violation of the Rules.

II. Consent to the General Terms and Conditions and changes to their content.

1. By fulfilling the requirements described in item 1 of these General Terms and Conditions, the Participant declares that they are familiar with these General Terms and Conditions, agree to the clauses, and undertake to unconditionally comply with them.
2. Given the periodic addition and modifications of the campaign and its improvement and expansion, the General Terms and Conditions may be unilaterally amended by the Organizer.
3. Amendments and additions to these General Terms and Conditions are published on the vida.bg website and come into force for all participants on the day of publication.
4. The Organizer terminates the participation of a Participant who has explicitly stated via email to the Organizer that they do not agree with the amendments and additions to the General Terms and Conditions.

IV. Intellectual property rights

1. IMPORTANT! After providing the respective consents, the participant cannot change the information they have entered, given the lawful selection of a winner. To participate in the campaign, each person must have fulfilled the requirements for providing consent for the processing of personal data. If the person does not provide their consent, the Organizer has no legal basis to allow them to participate in the campaign. The Organizer is not responsible for inaccurate or incomplete contact details provided by users. Each participant can withdraw their consent at any time. If a participant withdraws their consent during the campaign period, the Organizer is obliged to stop using their personal data, which will lead to their removal from further participation.

14. The content of the campaign is available for viewing by any visitor on the website vida.bg.

2. By accepting these General Terms and Conditions, the Participant declares that their participation in the campaign is entirely at their own risk and responsibility.
3. The Organizer is not responsible for the inability to ensure participation in the campaign in the event of circumstances beyond its control – cases of force majeure, accidental events, problems in the global internet network, and in the provision of services beyond the control of the Organizer.
4. The Organizer is not responsible for any disturbances or technical problems preventing the use of the website vida.bg, as a result of the Participant's equipment operation.
5. By accepting these General Terms and Conditions, the Participant declares that they are aware of the possibility of eventual interruptions and other difficulties in establishing an internet connection to the Organizer's website, which may arise regardless of the care taken by the Organizer. The Participant declares that they will not claim any compensation from the Organizer for lost profits, suffered damages, or inconveniences resulting from the aforementioned interruptions or difficulties in the internet connection, including with regard to the capacity of this connection.
6. The Organizer does not guarantee that participation in the campaign will be uninterrupted, timely, secure, and error-free, insofar as this is beyond its capabilities, control, and will. The Organizer is not responsible for the loss of stored information, system failures, or the occurrence of technical problems related to participation in the campaign.
7. Penalties and compensation.
8. The Organizer has the right to immediately and without notice suspend and restrict the Participant's participation when the latter acts in contradiction with the law, these General Terms and Conditions, the rules for using the website, morals, and good customs. This right is exercised by suspending the Participant's access to the campaign's website, as well as by removing any text published by the latter.
9. In the above cases, the Organizer is not liable for damages suffered and lost profits of the Participant or third parties, incurred as a result of the suspension, restriction of participation, removal or deletion, modification, loss, untruthfulness, inaccuracy, or incompleteness of messages, materials, or information transmitted, used, recorded, or made accessible through the campaign's website or mobile applications.
10. When there are sufficient grounds to believe that the Participant's action could constitute a crime, the Organizer notifies the competent state authorities, providing them with all necessary information and materials that would help identify the perpetrator and prove the committed crime.
11. The Participant is obliged to compensate the Organizer and all third parties for all suffered damages and lost profits, including paid fines, for any expenses and paid attorney's fees, incurred as a result of claims filed by and/or compensation paid to third parties in connection with their participation in the campaign in violation of applicable law, copyright, these General Terms and Conditions, and the website's operating rules.

VIII. PROTECTION OF PERSONAL DATA

24. Vida Wine and Spirits Ltd., in its capacity as a personal data controller, undertakes, in accordance with Bulgarian and European legislation, to collect and process the personal data of participants due to and in connection with the conduct of the campaign, as well as for any other purposes not prohibited by Bulgarian and European legislation. Every natural person has the right to access personal data concerning them through a written application, to receive information about the purposes of processing and use, as well as the right at any time to request "Vida Wine and Spirits" Ltd. to erase, correct, or block their personal data, the processing of which does not comply with the requirements of the legislation, in the ways provided in the Personal Data Protection Policy.

IX. Other terms

1. Written statements and communications provided for in these General Terms and Conditions shall be deemed validly made if they are in the form of an email message.
2. In the event that the Participant has provided an invalid email address, the statement will be considered received upon its dispatch by the Organizer, even if it has not been received.
3. The parties declare that if any of the clauses of these General Terms and Conditions proves to be invalid, this will not lead to the invalidity of the General Terms and Conditions, other clauses, or parts thereof. The invalid clause will be replaced by the imperative norms of the law or established practice.
4. For all matters not regulated by these General Terms and Conditions, the provisions of the current legislation of the Republic of Bulgaria shall apply.
5. All costs associated with the Participant's participation in the campaign, such as access to the Internet network, etc., except for costs that, according to these General Terms and Conditions, are borne by the Organizer, shall be at the expense of the Participant.
6. All disputes between the parties shall be resolved in a spirit of understanding and goodwill, including by following the procedure outlined above. Should an agreement not be reached, the dispute shall be referred for resolution to the competent Bulgarian court with its seat in Sofia.
7. By accepting these Campaign Rules, the participant is considered informed that any material prize with a market price exceeding BGN 100 is taxable under Article 13, paragraph 1, item 21 of the Income Taxes on Natural Persons Act. The obligations for declaring and paying the tax are for the Organizer. In this regard, by participating in the campaign, participants agree that, if they are drawn as winners and receive a prize above the determined market price, they will provide their personal data (full name and national identification number) for the purpose of fulfilling the Organizer's legal obligations, in accordance with the Income Taxes on Natural Persons Act.

These general terms and conditions come into force as of 5.9.2022.
